Q: I just got a cell phone while driving ticket in unicorporated Melrose Park Il.I also did not have my insurance card

I do have my current insurance card and will bring it to court.I have a clean record and what are my chances on the getting out of the cell phone while driving ticket?

A: The insurance ticket will be dismissed if you show that you were covered at the time of the ticket. If the officer is present and you plead guilty to the cell phone violation, you may be granted court supervision, which would keep the offense off of your public driving record if you do not receive any additional tickets during the supervision period. You can also plead not guilty and have a trial. Success at trial depends on a variety of factors including the officer's recollection of what took place and his/her ability to testify credibly. First offense cell phone violations are considered moving violations as of July 1st. You will want to keep this ticket off of your record.

A: Hopefully you can show that you had insurance in the date and time you were ticketed and if so, that ticket will be dismissed. The Cell Phone ticket will likely not be dismissed and you will want to request Court Supervision.
