Bossier City, LA asked in Child Support for Louisiana

Q: Can the state legally garish my wages without a court order to do so?

I’ve been paying my wife court ordered child support since March 2019. I haven’t missed one payment and she just now decided to go through the state and let them take care of it. I received a notice in the mail for a redirection of child support from the state. They stated that I failed to pay my child support and recently garnished my wages since I didn’t pay the child support through them. Instead, I’ve been paying child support directly from my checking account to hers. Did the state overstep legal boundaries by issuing a garnishment of wages to my employer without a court order to do so?

A: Garnishment only should have been possible if you fell behind. Make a chart showing every payment you made and print every cancelled check. Then hire a. child support attorney.
