Q: My ex has been receiving CS for 2 years she was recently arrested 2 times for theft could CS be stopped because of it?
She has been in an out of jail since their birth only 2 years ago she came into their lives there 9 now so we went to court they immediately gave her 50-50 even being absent for so long. It’s been a battle she is well known in the courts but how addicts are viewed now is different than 10 years ago. She took them from my school district I petitioned for contempt but I lost even tho I had everything in my favor. But recently I found out she was caught and charged with stealing twice within a year. Now I pay a substantial amount due to me working in the oil&gas industry and she’s on all government assistance. What could I do to say hey she receives all this CS and assistance but yet she’s still out stealing. I’ve paid so much in lawyer fees but I’ve had the same results with or without an attorney. So I’m asking for being arrested could child support be stopped and gain full custody again because of the environment she has created for them.
A: Retail theft is not one of the crimes that the custody court is expected to consider when making a custody determination. I wouldn't think that you can have the support stopped based on these charges either. Obviously you're very frustrated with the court system but these arrests are not likely the aces in the hole you are hoping for.
