Q: Can I file for child support in GA now even if I declined to file when I initially divorced in March 2018?

My divorce was final early last year, and I got custody of my 4 kids. I decided not to file for child support due to my ex wife only getting around $1750/month in VA disability. Since then, she's gotten her disability increased and now gets $3600/month. She also received back pay of over $25k. I was told by child support services I can't get a modification until 3 years have passed. Since I didn't file, is this a modification? How can I require her to pay child support for my children?

A: You don't have to deal with the child support agency at all. You can file a modification of your divorce to ask for divorce.
