Aurora, CO asked in Car Accidents for Colorado

Q: What do I do if I know I’m not at fault and have witnesses involved in accident?

I was t-boned on driver side I did have my child behind me and 2 other people in the vehicle with me I was coming out of a private drive making a left hand turn now I know most likely they say the person at fault is the one making that left hand turn but In this case it wasn’t my fault I yielded as I should have done for about 5 minutes, no vehicles were coming so I proceeded! Mind you the speed limit was 35 on the I-70 frontage road where it happend There was a white Subaru suv coming towards us but was a ways back to have stopped in time but was speeding of more than 35 mph the impact was so hard we spun and ended up being pushed back in the parking lot we were pulling out of, air bags were deployed and my vehicle was totaled I did recieve the ticket because I was coming out of private drive ! I don’t think it’s fair because I know the rules and did what I supposed to the other driver in this case was clearly speeding, and distracted as he told us he didn’t see us wheat ridge CO

A: The problem in these types of situations is that the speeding driver is not going to admit that, and unless there is some type of footage, it's difficult to prove. Depending on what is at stake, carriers will sometimes reconstruct the mechanics of the accident, investigating skid marks, vehicle damage, injuries, and other factors. Good luck
