Q: This question relates to my answer/ reply from "Rand Scott Lieber"

Thank you for your reply. I should have specified the immediate issue. We have been married for almost 15 years. I know I will need to give support etc... My immediate issue , we don't have very much money right now. I"m trying to solve how I get her to move out since I don't have immediate funds to help her do so. That is the problem/issue. Can I give her an ultimatum on timing to move out? But I feel if there is no real deadline etc, she will never save money and leave. So, I'm trying to find advice on how I can facilitate this process moving forward as I know she can't and probably will use the excuse ,and won't move out ? I feel stuck and I don't know what to do

A: It sounds like you are the breadwinner. Do either of you have local family or friends? Is there somewhere that you can move temporarily? You are correct that you cannot force her out without somewhere else for her to go. You also did not mention if you own the house. If the house is owned and there is equity then she would be entitled to half. With that money she may be able to get on her feet; however, that does not solve your immediate problem. It sounds like it is on you to find her a place to live, one way or another.

A: Without court intervention, there is no way of "making" her move out. All you can do is choose to leave and leave her in the home. As another poster indicated, if the home is owned, she's entitled to her marital share of the equity.
