Seattle, WA asked in Probate and Estate Planning for Oregon

Q: Ok so. My mom and her best friend cooked or forged my fathers will at death. My mom was friends with my ex shes a notar.

She notarized the will. After dad died. All of this was coached by my moms best friend. Fast foreward to june or july this year mom get put on hospice. At the meeting with hospice moms best friend says hes not the executor said didnt sign anything. Mom tells me she didn't have him do it and that no one was exec. Said myself and my brother get 50/50 of the house and estate. Well time goes by moms best friend starts coaching my brother on the subject. Next thing theres a disagreement between russel (moms friend) and myself then after that things got weird. My brother starts acting distant and being shady. Mom passes will pops up russel is executor now and EVERYTHING goes to my brother except a small payment to me once house sales. What should i do? Theres a no contest clause they added to the will

A: I'm sorry for your loss. It is important that you meet with a probate attorney to help you evaluate your situation. There are important deadlines in a Will contest case so I encourage you to schedule an appointment as soon as you are able. Be prepared to pay for the attorney's time at his/her hourly rate.

A: This is the type of situation where you need a consultation with a lawyer where the lawyer can ask you the questions that need to be asked to sort this out and review the documents which are relevant. This is not something that you can get a quick answer on AVVO. AVVO is a public website so it would not be appropriate to conduct a detailed conversation on AVVO.
