Asked in Criminal Law and Probate for Tennessee

Q: Unsupervised Probation Violation by Probation office.

I was put on probation for 2 counts of Sexual Battery, during my probation period I was able obtain unsupervised probation. There was one probation officer that did not like me and was always trying violation me. While on unsupervised few months into my my probation was to end. She was able to violation me yet she was not my Probation officer and did not have one. My former P.O told me he has toss all my files out. How were they able to violation me? Is there something I can do to take action to protect myself from this matter and the fact I was unsupervised and they write a violation report against me. From my understanding when your on unsupervised only way to violation is from a new case and the clerk and court issues the violations instead of Probation office while on supervised that gives it to DA.

A: I think that you need to obtain a local attorney to investigate the matter. It is difficult to know all the facts online.
