Q: How can I get my visitation agreement adjusted?

My children’s father recently took me to court to seek custody 50/50. It was granted to him. Since then my oldest who is 10 has started to struggle in school, he’s usually tested for gifted every year and now he’s barely passing. During his last parent teacher conference which dad “couldn’t attend” even tho it was his scheduled visitation day, his teacher’s asked me if he’s talked to me about how he’s feeling emotionally since we’ve started doing the exchanges. My youngest teacher’s have also noticed a change emotionally. Also their dad is leaving them in the care of their grandmother, instead of him having them full time like he seeked in court. This past Sunday they went to church with her and couldn’t find her after service so my 9 year old and 4 year old were alone and had to walk to their great grandmother’s house under 0 supervision. Is this situation enough evidence for the judge to allow them to stay with me during the school year and also no longer with their dad’s mother?

A: It may be enough. Put everything on a calendar. Then have your custody lawyer depose the teachers.
