A: The legal age of consent in the state of Georgia is 16. Anyone under that age cannot legally agree to have sex. The law only provides an exception for married individuals. Statutory rape may be a misdemeanor or felony sex assault charge, depending on the specifics.

Additionally, a person commits the offense of statutory rape when he or she engages in sexual intercourse with any person under the age of 16 years and not his or her spouse, provided that no conviction shall be had for this offense on the unsupported testimony of the victim.

You may contact your local police department and/or Department of Family & Children Services (DFCS) in your county for enforcement.

It is best to consult an attorney dedicated to juvenile law. We are glad to assist you. Contact us today!
