Longmont, CO asked in Criminal Law for Colorado

Q: Is it illegal to obtain goods or services with the intent to reverse the funds or charge back the funds? Colorado.

What statute or municipal code would this fall under.

Theft from any person anything of value thru the use of deception, suspect vehicle was held for cash payment only as stated on his invoice, suspect made payment online and stated that his wife mentioned that it was christmas and after this job we go our separate ways, suspect was told his payment would not be accepted it was cash only as he has demonstrated a history of chargebacks, suspect texted saying he would call the police and i was holding his car hostage and extorting him. Because he made the payment I delivered the vehicle and he immediately started to harass me via text message. suspect: "If I dont have my vehicle back you will wake up a felon, don't push your luck, I want receipts for everything on the bill" suspect removed his verified address from a mutual card processor to take away any buyer protection I had with the processor. the customer then charged back the full amount of the job "product not received.

A: Yes. It is theft if the person obtains the goods, reverses the charges and keeps the goods.
