Q: This is an initial custody case, I have filed for 50/50 custody/parenting time, etc.

My sons father's lawyer is requesting bank and credit card statements, I'm confused how the is relevant evidence, since that information is not calculated in regards to child support, so how is that information needed or going to be used? How do I object to that request? His lawyer said he will send paystubs and tax returns, I can ask for more of his info, but why would I? I was under the impression the state uses a certain calculation based of income and overnights to decide how much should be paid.

A: This information might be relevant to prove what the correct amount of Child Support should be. The type of information they're asking will show your spending power and could lead to them asking about other sources of money that you have other than the income you are declaring. So yeah they can ask for a lot of financial information.

Just FYI your post says that you are asking for 50/50 custody. Please understand that in Oregon a court will not order 50/50 custody unless it is something that both parents agree to.

If you have questions or concerns I highly recommend that you make an appointment and talk to an attorney. Waiting until after the judge makes a decision and you find out that you didn't correctly anticipate things will be too late. You can always pay for a consultation to get information and advice without retaining an attorney which is more expensive.
