A: Not necessarily. The legal standard is actual physical control. You will need a lawyer

A: It's possible. The law is complex and only requires actual physical control of the vehicle. Your attorney will need to review the evidence to determine the likelihood of success.

A: Like everyone else said, it depends. Factors like were the keys in the vehicle and was the vehicle, in its condition, able to run come into play.

A: You need to hire an attorney right away to assist you with this matter. That attorney will gather all of the needed information and discuss your case with you. The sooner you hire an attorney, the better.
