Asked in Family Law for Florida

Q: My wifes ex is trying to get 50/50 custody of my stepdaughter how do i stop this?

He smokes marijuana. He is always late or finding reasons to not pick her up. He was absent for her first year of life. His brother is a child molestor and an active part of his life. He is always late on child support. And he does not live in my step childs school district.

A: In Florida, most children's issues are evaluated based on the best interests of the child. When a parent goes to court to modify timesharing they must show why the modification is in the best interest of the child. The mother will have the opportunity to present evidence in support of her position. You should consult with a local experienced family law attorney for more specific help.
