Q: If I have given my ex 5 written certified mail 30 day notices and he refuses to leave.

How long after I file the unlawful detainer will he have to get out. He has no lease,month to month, 3 police reports for violence, conviction for disorderly conduct and he is running my bills up on purpose. He's loud, drunk, and crazy. I want him out as fast as I can get him out. Will he get another 30 days? I live in Hanover VA. It's my mom's house,I'm P.o.a. It's been 2 years but he always makes you feel sorry and he gets more time. I just served another 30 day written it's the 5th on every door in my house. I plan on going to court tomorrow but I want him out now. Help

A: In order to have your ex-spouse ordered to leave the premises, you must have a court order. You can file an Unlawful Detainer, have it served on him and then ask a judge to enter an Order for Possession.
