Q: I am sick from living in horrible conditions in my rented house. Can I get out of my lease? Sue for damages?

I am living in a rented slab home that had sewer work done in the house starting Jan 2nd. I have been living in a trashed home since: cement and sewer mud dust is on everything. Now I am ill. They don't take the cleanup seriously. Cheap help may be coming. I am thinking I might want to sue to break lease and for damages. The owners are liars and con people and now are mad at me since I called Ballwin City Hall to have them fix the sewer right. They say y troubles are all may fault and that they had to pay a lot more to fix. I don't want to live with such recriminations. Terrible people. They might do me more harm. I am a senior, living alone, and now I am very ill and having trouble working. Please let me know if I can get any help!!!!!

Yes, you can file a lawsuit. Whether you win will depend upon the claims you plead, the facts, the law, and (most likely) whether the parties hire counsel. I suggest that you meet with and attorney to review the lease and all of the facts and explain your options. You are unlikely to find contingency representation for this type of situation so expect it to be costly. Also, given that your landlord claims you have caused damage (and I'm not saying that is true), expect that if you sue your landlord will file a counterclaim.
