Metairie, LA asked in Adoption and Family Law for Louisiana

Q: Intrafamily adoption reversal?

I am 15 and was taken in by my cousin when I was a baby and got my last name was changed at 4 years old. However, my cousin has been emotionally abusive all my life and has cause me severe mental health issues all my life. She has also been physically abusive but not as much as I got older. I have always been in contact with my birth mother and although she was not stable enough to keep me when I was born, she has gotten significantly better since. She has a stable job and her own place and has wanted me back ever since I was taken away. Is there anyway that custody can be given back to her? Do I have any sort of say in where I want to live?

A: Although the adoption is not "reversible," your mother can still file seeking custody. Because she would be treated as a non-parent, her burden of getting custody would be high, and you would need to provide solid proof of the abuse you've described. If the abuse is serious, you or your family should consider reporting it to the authorities. Good luck.

A: An adoption is not reverseable. However your mother can file for Ex Parte Custody or Custody with a lawyer.
