A: There is no age requirement; "elder law" or "elder care law" encompasses disability law as well.

Elder care lawyers usually attract clients over 60, but many of the issues they handle (e.g., how to plan for long-term care, how to protect public benefits for someone who may be getting a windfall settlement or inheritance) are experienced by people of any age. For example, I am working on a revision to the estate planning for a couple who had a testamentary Special Needs Trust in their wills for a disabled child, but now, we plan establishing that trust now so that they can set some money aside for him during their lifetimes without threatening his eligibility for public benefits.

Whether someone consults an elder care lawyer depends more on the legal issues than the age of the client.

A: There is no age requirement, so to speak. One can begin planning for elder law issues, depending on what those issues are, early on in life, if that makes sense. We do provide elder law services and would be happy to speak with you further. www.boppguecia.com
