Q: My son just got a Arrested for Domestic violence 1st charge for his son mom he in the camden county jail as i speak

He go to court tomorrow what can i do will he come home in a OR i need answer i need a lawyer

A: A lawyer can definitely help him, but you need to take the first step and hire one of us to defend him. If you cannot afford a lawyer a public defender will be appointed for him, but don't expect them to give any priority to his case as most are snowed in with cases.

A: Thank you for your question. I am sorry to hear that this is happening. If your son was arrested, I presume that one of the charges he is facing is for assault. If he is charged with assault, he likely has two court proceedings arising out of the same incident. One court proceeding would be in Municipal Court for the criminal charge and the other in the Family Court. Your son has the right to request a postponement (or adjournment) of the court proceeding tomorrow for the purpose of retaining counsel. As a general matter, the court will grant his request to give him time to consult with and possibly retain counsel. The restraining order against him will remain in effect during that time. I strongly suggest he retain an attorney for any court proceeding involving this matter as there are significant consequences involved when there is a Final Restraining Order entered against you.
