Q: I know Michigan is a no fault divorce state, my question my husband fathered a child during our marriage. Can I sue her?
For alienation of affection from my husband? My husband and I have no kids and have been married 14 years. I want a divorce. The only property is home furnishings and 2 cars both in my name. Is there anyway that I can require him to help pay the note for the car that he drives? I’m retired and get medical disability as well as my State pension. I was forced to retire due to an injury during the commission of my duty as a corrections officer for the State of Michigan. I would like to not have to give him any portion of my pension as while I worked for the family he was out having an affair and fathered this child. Please help me explore my options and walk away from this relationship with peace of mind. Thank you.
A:
You can safely give up the notion of suing this other woman. What duty or obligation did she have with you? Your husband, on the other hand, does have obligations to you, and he's the one you should focus on. His fault in having this extramarital affair can be one factor in a spousal support allocation.
Beyond that, be aware that the court cannot bring you peace of mind in these sort of matters. A judge will not scold your husband, or ultimately determine you're good and he's bad. As to the divorce, keep the focus on the property, assets, and debts, and seek professional counseling for the other issues.
