Q: Can they reinstate my child support even if it was canceled six years prior by the ex and she didnt ask for it

I was given 50/50 custody with all support and arrears forfeited voluntarily by my sons mother in 2010. I was incarcerated fro. 2012 to 2016. She received healthcare for my sons from the state in 2016. 1 month out of prison, literally with the shirt on my back my only possession, while living in a halfway house, I was made aware of the friend of the court inquiries into my finances for what they were.. 6 months later in 2017 the started hitting me with support again. Healthcare was $15 a month for 2 boys . $30 ...instead of having me just reimburse the state they tack on child support for her just because. WTF. Now they automatically put me in arrears for $2600 . Again WTF. My order was signed In may 2017 . they said they charged me for the 6 months that they were investigating my case. So they charged me for something that didnt exist for those 6 months.. How does that fly. And how can they play Robin hood and give her my money without her making any kind of petition to the court for.

A: This happens a lot and here's why: When someone asks for state assistance for a child (e.g. MI Child, food stamps, etc.), you are inviting the state into your business. It does not matter what the mother says or what you both otherwise agree to.

Arrearages accrue from when a child support order goes into effect, which is often the date of filing. That is why you suddenly found yourself owing six months.
