Warner Robins, GA asked in Family Law and Child Custody for Georgia

Q: Can my ex wife refuse to give me visitation due to fear of corona virus?

My ex wife is refusing to give me visitation with my daughter until the Corona virus outbreak is over. I typically have my daughter Wed night and return her Thursday morning and 1st and 3rd weekends and alternating 5th weekends. She says she is protecting her family but I'm not sick, neither her nor her family is sick and no one has had any contact with anyone who has tested positive or is suspected and no one I know is. I have talked with the police and they said they would send a deputy out but seems like they will only write a report. She means to keep me from my daughter until August or September. Any suggestions would be greatly appreciated.

A: You need to consult with an attorney. First, you aren't going to go until August or September without seeing your daughter. The first step is to try to work it out with your ex, outline your social distancing and cleaning procedures in your home. If she still refuses, the court may grant an emergency request on a contempt filing.

A: You definitely need to consult with an attorney as soon as possible to discuss filing an emergency motion for contempt.

A: She would be in contempt if she doesn’t allow you to see your daughter. You should immediately consult with an attorney who can help you address this legally. -Homer P. Jordan IV, Esq. 404-620-1558
