Q: I slid on black ice in Dec. 2018. I hit a guardrail. My front end was damaged, and I was later billed for the guardrail

by Jackson County. No ticket was issued. A state trooper witnessed the accident as he was en route responding to another driver who slid off the road in the same location a few minutes before me. Because I saw the officer approaching with lights activated, I had already slowed down and was not driving recklessly. I just received a notice from the State (Mar. 2020) that this resulted in 3 points on my driver's license. How can I get points on my license when I wasn't issued a ticket or given the opportunity to contest?

A: More than likely a Citation was issued and somehow you did not get a copy. THP gets away with all kinds of things. Call Jackson County General Sessions Court and inquire for December 2018 through March 2019. The MVR is only for the last twelve months, so there may be a conviction in March 2019 and forward. You are probably too late to request a DOS Hearing, but I would read that DOS Notice verbatim. You may be lucky they did not revoke your TNDL for nonpayment.
