A: A New Mexico attorney could best address your question, but your post remains open for two weeks. As a general matter, it's really in your hands. If you do attempt to help neighbor, that's nice of you and I hope nothing happens to you in the course of the work. But if you did injure yourself, the homeowner's policy could deny any claims brought by you. So it would be up to you not to sue - no one says you have to sue if something happens. If you agreed to sign a waiver, as a matter of public policy, they are frowned upon by courts if they seek to exclude remedies for injuries. Although it sounds like you want to help your neighbor, from the standpoint of risk from a potential claim, it could be less financial exposure to her or him if they hire a contractor with workers' comp coverage. Good luck
