Q: Would there be probable cause in this situation?
Let's have a crime that has been committed at a specific spot. The time frame of the crime is known. The spot of the crime is under video surveillance. During the known time frame, only one person goes to that specific spot and video shows this happening. (In this case, the suspect can easily be identified via the video footage and locating this person, if necessary, would take minimal effort) Unfortunately, for whatever reason, video failed to capture the actual crime being committed. What it does show is that the suspect (who is the only individual videoed reaching that point) comes to the specific spot and and comes to a complete stop. It is at that instant when he comes to a complete stops at that spot that video ends. There is other evidence that can be processed at the scene. Is there enough evidence to have probable cause to continue to investigate to find the identity of the suspect in order to investigate who committed this crime?
A:
I agree with my colleague. The threshold for probable cause is rather low and does not have to rely on one element alone to be proven. Under the circumstances described, the individual(s) involved may benefit best from contacting an attorney who can assist with the specifics.
We are glad to assist. Feel free to contact us whenever you are ready.
I wish you well.
