Q: what can I do if I know my ex isnt taking covid19 seriously and is refusing to social distance and no ppe when out?

My ex is still babysitting during this pandemic and exposing my daughter to this covid19. I have seen it with my own eyes of the kids being outside unsupervised and she lives on a busy street. She already has 3 kids and I’ve seen at least 3 others. On top of those 2 things she has sent my daughter over here with lice 3 times in the last 6 weeks. We try to talk to her but she says my daughter didn’t get it from her house and my daughter states her brother also has bugs in his hair. And lastly she refuses to allow my daughter call me, she involves her in everything and makes her remind me how long I have until child support and tells her she can’t spend more time over here because of court. She talks bad about me constantly in front of my daughter and even when as far as to tear up pictures of me and my daughter in front of my daughter. I’m seriously at my wits end and just need some guidance as my daughter is my life. I can prove it all! I want to file

For emergency custody ultimately.

A: If you feel that the child is being endangered by not being assisted in social distancing and emotionally, for example, based on tearing up photos, you could file for an emergency custody motion. You would have to prove endangerment, which can be a high bar. The COVID social distancing is a new phenomena, so there is not case law yet on how courts are likely to look at pandemic endangerment issues.
