Houston, TX asked in Uncategorized for Tennessee

Q: What is considered proof that you are a sole heir in Tennessee?

There was no will. Veterans Administration sent a check to last known address made payable to the estate. Bank would not cash. VA wants proof that wife is the sole heir before they will reissue check. How does she prove she is the sole heir?

A: Hire a competent attorney to draft and execute an Affidavit of Heirship. It should also state who the sole Next-Of -Kin is (the same person as the heir). If it is a substantial sum, record it first, then send it to the VA with a letter requesting the check be reissued in the name of the sole Next-Of-Kin of the Decedent.
