A: Filing the application can take 2-3 weeks. Then there is the processing and prosecution time with the USPTO. Generally, it is best to first file with the USPTO. At the same time, we can file with the World IP Organization under the Patent Cooperation Treaty. This can be done within the same 2-3 week period. This will be the beginning of your international patenting process. At this point, you are "Patent Pending."

Then, a longer period includes the prosecution or procurement of the patent through the national offices.

U.S. filing fees range between $250-800; international WIPO fees are nominally $3,500. Legal fees can range between $6,000 - $10,000, as a function of the invention's complexity.
