Q: After 7 years, my daughters father wants to be in her life. She was born out of wedlock and is now 9. what can I do?

Her biological father has never given me any type of child support. At 3, I decided to keep him out of her life due substance abuse and left it there. Ever since my daughter has only seen him 3 times in 6 years. My Spouse has raised her ever since she was 3, has provided for her as if she was his own. My daughter sees him as her actual father. He claims he's changed his life around but this has happened in the past as well.

A: You should consult with an attorney. The court will need to make a determination of whether allowing the biological father to legitimate is in the child's best interest. If the court denies the legitimation, your current spouse may be able to complete a step-parent adoption of your daughter.
