A: If your daughter was born while you and her mother were married, you are her legal father and have the legal right to make decisions as it pertains to her. However, if your daughter was born out of wedlock and unless you have legitimated, in the eyes of the law you are not her legal father and cannot make such decisions as it pertains to her. It is best to contact an attorney who can assist you with the specifics of your circumstances.

I wish you well.

A: If you are married, yes you can, but it seems like if you are posting this question, things are not going well and she might call the police. It probably is not worth it. If you are splitting up, talk to a divorce attorney about your options.

A: As long as you have legal rights to her (you were married when she was born or you have legitimized her) then you can take her without your wife’s permission. You wife can do the same, taking her without your permission. -Homer P. Jordan IV, Esq. 404-620-1558
