Valdosta, GA asked in Family Law and Child Custody for Georgia

Q: How would I go about pursuing the involuntary termination of my exes parental rights who is unfit parent?

My ex husband has never been in my daughters life he has been absent most of her life and she is 10 years old. He has been diagnosed with several mental health disorders and is currently in jail and I want to get his parental rights terminated before he is released. My daughter fears him and I fear him he is mentally unstable and he has never held a steady stable job or even a home for long. I just need to know how to go about getting his rights terminated while he is still in jail because now that he is caught and trapped he is trying to reach out to our daughter by letters and it terrifies us both.

A: You need to consult with an attorney to discuss the specifics of your case. Typically, terminations of parental rights are not granted unless a third party is present to adopt, such as, in the case of a step-parent adoption. However, under the circumstances, you may be able to file a modification of custody action seeking sole physical and legal custody, which would limit the father's rights.

A: You should consult with an attorney who can review the facts of your case in detail and help you plan the proper course of action. -Homer P. Jordan IV, Esq. 404-620-1558
