Q: Hey I question for you guys! I recently had a a breakup with my girl which ended in a door being broken.

We don’t necessarily live together but I’m always there and I have a key. We were both running upstairs to the apartment which she can attest to this and closed the door in my face and when I tried to run inside the door was locked and it cracked the frame. She then unlocked the door and let me in, where I grabbed all of my belongings and left. She then couldn’t find her phone which was (under the couch) so she thought I took it. So she called the cops when I left. They are now charging me with aggravated burglary and theft( though I didn’t harm or steal anything). I didn’t trust her with my equity cause she destroyed my glasses and my phone that day. I have messages from the next day of her apologizing to me for everything (punching,scratching ,breaking my glasses,and phone ). I don’t have any type of record or violent history and the story that was reported was totally over exaggerated. We were both drunk and had an accident with the door. But now I’m facing this charge..help me!!!!

A: Make sure you save the text messages from her. Take a screen shot of them and save them to a file or print them out. You will need them as part of your defense. I recommend hiring an attorney to fight for you. Your attorney will discuss your case with the DA and hopefully come to a resolution. Depending on the facts, your case could possibly dismissed. If there are enough facts for a charge and you've never been in trouble with the law, you may qualify for judicial diversion. First things first, hire an attorney, Don't try to battle this out yourself.
