Queens, NY asked in Child Support for New York

Q: Child support arrears after seven years is six fugures. 7 years on public assistance. Will they modify

I’ve never been able to afford the order. They never modified the order even though I am in the system on public assistance in the same state

A: There is no "THEY". YOU need to take active action to modify your order. No one will do it for you. Just because you were on public assistance, you still had a court order obligating you to a certain payment. You need to go to court to get that modified going forward.

A: You can only modify child support going forward, arrears will not be retroactively adjusted. Nobody will make a court application for you. Make an application to modify support if you cannot afford it.
