I filed a ex parte for sole custody bc she is threatening to leave the state. It got denied, do I have to return my daughter to her mother?
A: Yes. Without a court order, you have no authority to keep the child from the other parent. If you have ongoing concerns, and since your ex parte was denied, you can file a regular motion to change custody.
