Alpharetta, GA asked in Family Law and Child Support for Georgia

Q: Can I file for child support against the father if he is not legally the father but has been in child's life since birth

Me and the father were together for 12 years, our son is 12 years old. We recently parted ways, however we were never married. He knows he is not the father, but our son doesn't. This is the only father he has known.

Answered

A: No. Unless he adopted your child, he has no legal obligation to support your child.

A: If he didn’t legally adopt the child then it’s not likely that he’d be ordered to pay child support. However, you can seek child support from the biological father. You may want to consult with an attorney who can help you with your case. -Homer P. Jordan IV, Esq. 404-620-1558
