Asked in Family Law and Child Custody for Georgia

Q: Do you have to be served or notified of parental rights being terminated while incarcerated at rehab facility

I was in a state drug alcohol facility and wasn’t allowed to talk to my 12 year old son the entire time.

Once released I tried contacting father to find out when I could see him and he told me my rights had been terminated but I haven’t been served and can’t seem to get anyone to produce an order stating that.

The last order is that I get every other weekend and reasonable phone time.

They won’t answer the phone now at all.

I haven’t spoken to my child in 20 months.

I don’t know what I need to do.

Just trying to figure out if my rights can actually be terminated without me being served and if so, can I get them back?!

A: You would have to have been served prior to your rights being terminated. Contact an attorney who can research the court and find out for sure.

A: There is a good chance you still have your parental rights, because you should have been informed if you had lost them. You are not getting anywhere trying to rectify this on your own. You are going to need to work with an attorney. Consult with an attorney who can review your case in detail and help you plan the proper course of action to address the situation. -Homer P.
