Q: Can i sue an insurance company for not doing a full investigation on a claim?
another driver recently hit my truck and I filed a claim with their insurance company. They denied the claim without asking for photos of the accident that I believe clearly shows who is at fault. They never even looked at our vehicle to see the damages. I was hit in a parking lot that has cameras and their insurance didn't try to obtain the video evidence either. They just simply said no because their driver said they didn't do it.

As a general matter, the insurance company of the other vehicle does not owe you a duty to protect your interests. They need to worry about protecting their insured. You could contact a West Virginia attorney to discuss your options. It's difficult to say whether video for the parking lot has been recorded over by now, some three weeks later. But if the footage is gone, your respective accounts of the accident are conflicting, there is no police report or witness statements, and there is no means of reconstructing the accident based on the impact, it could be a tough case.
