Canton, GA asked in Family Law for Georgia

Q: Can I restrict fathers visitation from being at his house? Baby- 2months old.

Have not picked a lawyer yet. We will have to do paternity test and so forth, baby is out of wedlock. Father is verbally and financially abusive, gives no support and has no education on infants or connection to her. I want to file for child support. If he has visitations can I restrict it from being at his house? I fear it’s unsafe, his dogs has tried to attack my baby twice, poop/pee not cleaned up, trash and clutter all over and guns/tools not put away.

A: Since the father has not legitimated, he has no visitation rights at this point. It is best to contact an attorney as soon as possible.

A: Wow! That does not sound like an ideal situation for an infant. You would be filing a Petition to Establish paternity and child support. Until he legitimizes your daughter, he has no right to visitation. The right attorney can assist with crafting a graduated plan that would include him having safeguards in place for your daughter's safety and well being. At the Edwards Law Group we pride ourselves in helping our clients craft out-of-the box solutions for issues like yours.

A: It sounds as though he has no rights to the child at this point. You should consult with an attorney regarding going forward with seeking child support. -Homer P. Jordan IV, Esq. 404-620-1558
