Q: What is the limit For being over the speed limit for receiving a continuance on a speeding Ticket in Ramsey county MN

I was going 26 over and would like to know if I am eligible for a continuance for dismissal on my ticket

A: Anyone is eligible for a CFD, but given that you were 26 over, it is incredibly unlikely that you would receive a CFD unless there are serious evidentiary issues with the government's case against you. It also depends on your driving record as well. You don't indicate in your question what your driving record looks, but a bad driving record also minimizes the likelihood that you would get a beneficial disposition. There may be a way to reduce the severity of the ticket even if there isn't a way to get a CFD. Anything you can do to reduce the speed from 26 over to something less than 26 over is going to reduce the hit to your insurance rates and it will reduce the fine as well. You should serious consider retaining counsel to get the best possible result in your situation.

A: It's up to each city prosecutor to decide what they are willing to offer to attempt to reach a settlement of a case. But in general, prosecutors are more willing to offer a Continuance-for-Dismissal with Conditions, for people with a clean record over a 3 to 5 year period, and an alleged speed that is not higher than some number they want to use to draw a line. That said, when I am the defense attorney sometimes I can get a CFD for a client, despite a prior record or higher speed, depending upon many factors including the facts of the case.
