Q: Why did I get arrested?
I was at my mothers house yesterday and she started swearing at me in front of my kids, I told her to stop and that made it worse. She snatched my phone out of my hands and ran away into the living room where i seen her throw my phone as hard as she could to the ground, i went to to pick it up and she grabbed it and ran off again into a bedroom. I tried grabbing my phone out of her hands and while doing this she bit me and scratched the crap out of my arm. She fell onto the bed and i walked away. I bent down to pick up my 1year old and she kicked me in my back and in the back of my knee. I took my kids into the kitchen and she called the cops so i left and called the cops to file a report. They met up with me and ended up arresting me saying that i assaulted her!!!! I didnt touch that woman!!! So i went to jail and got out without having to pay bond but i cant contact her and she has my kids. What do i do? I truly didnt touch her! She assaulted me!!! Why did this happen like this?????
A:
The arrest decision was made by police based on their initial investigation. No one beside the officers involved can really say how or why other than they obviously thought probable cause existed that you assaulted your mother. It's a decision susceptible to human error in judgment, which is why you and anyone arrested is entitled to due process.
The next step is to get an attorney and figure out what evidence will be used against you. You will also likely have family court issues to contend with as well, so you may need to look in to the assistance of two different attorneys.
