Montgomery, TX asked in Family Law and Child Support for Louisiana

Q: What if I don’t agree with an increase amount? Also can they count overtime as income when it’s not guarantee?

I live in Texas now, case is in Louisiana. February 2019 went to court for increase because state said I had to. Now a year later they are saying I need another increase, well the mother is saying I need to pay more. Our daughter doesn’t want for anything and the child support I pay now is just a savings because my ex says she doesn’t even touch the child support it stays on the card. My ex claims she didn’t file yet the dcfsa says she filed. I don’t agree with the amount they are saying I should pay I only make 3200 month before everything taken out they have me down making 5000 a month. Last time in court they claimed my overtime and I said they shouldn’t claim my overtime because I’m only guaranteed to work 40 hours a week.

A: If you are now not making overtime then you need a decrease and should get a child support lawyer to go-to court. Overtime can be included if it is regular.
