Roswell, GA asked in Child Custody and Family Law for Georgia

Q: In 2015, my ex & I divorced & we had a 3 yr old son. I am looking for advice based on the original custody agreement.

We were living in Greenville, SC at the time of the divorce and custody battle. My ex was granted full custody due to an addiction issue I had had several years prior. I have been clean and continue to take drug tests, but have not seen or spoken to my son in over 5 years. His father moved to Florida with my son, to remarry without my knowledge. Is that legal for my ex to do? I currently moved back home to GA, where I have the support of my family. I am extremely broken over this and wonder what my son thinks happened to me. And what his father tells him. What would your advice be on how to move forward with this and if I even have a chance to reconnect with my son, Jaxon. Thank you so much.

Lauren

A: You need to contact an attorney in Florida. He has the right to remarry and not tell you.

A: I agree with my colleague. Unless your rights as the parent were terminated, you should be afforded the opportunity to have visitation with your son.

You must contact an attorney who is licensed in Florida because that is where the father resides.

We wish you well.

A: I agree with my colleagues. It would be wise to consult with an attorney in Florida who can help you with this situation. You should be able to see your son, unless your rights have been taken away. Working with an attorney you should be able to rectify this situation. -Homer P. Jordan IV, Esq. 404-620-1558
