Q: Are we in the wrong for having an expired insurance card even though our insurance is up to date?
My son got a ticket for an expired insurance card and expired tags. He has always had insurance coverage just forgot to switch out the card. Should he fight in court and try to get it dropped or is he in the wrong for not having the right card on him?
A: On almost any Rule of the Road Violation, the defendant needs to go to Court. He needs proof of current insurance at the time of the stop, such as the Policy Declaration Sheet. He needs to be respectful and ready to pay the costs. It should be dismissed. The Expired License Plate is different. He needs a valid Registration, with a 2020 or 2121 Sticker, and quickly explain to the Court what happened.
