A: A Florida attorney could advise best, but your question remains open for two weeks. As a GENERAL MATTER in many jurisdictions, the settlement award goes to the estate if the plaintiff dies. Going to next of kin could depend on the existence of a will or other arrangements - that's something a probate/estate planning attorney should advise on. 'Not from the injury? That might introduce variables that compound your question to the level of needing an attorney to examine the matter. Good luck
