A: A New Mexico attorney could answer best, but your question remains open for three weeks. As a GENERAL premise, such situations could be characterized as negligent entrustment of a motor vehicle - every jurisdiction doesn't use the exact same term. Loosely speaking, the victim would need to prove that the vehicle owner knew, or should have known, that the operator should not have been entrusted with the car. Will insurance cover? It could depend on the carrier - some carriers are more stringent about situations involving operators not named in a policy. Good luck
