If the parents are generally on the same page as to what the parenting time should look like when they separate, then mediation can be a really good tool to come up with a parenting plan. The parenting plan could then be incorporated into a custody order. This way, the parties both have something to fall back on when they have any issues in the future.
If the parents aren't in agreement what the parenting time should look like, then generally a contested custody case is used to decide the matter. This is usually started by a parent filing a custody action with the Court and the other party responding to it. The Court will generally enter a temporary order early on in the case addressing custody, parenting time, and child support so that the parents both know what the schedule is while the case is pending. Even most contested custody cases reach a resolution without going to trial.
