Q: My ex left the state for work but wanted to keep our week on week off schedule in place allowing his new wife

To care for our daughter during his normal week. I agreed to give it a trial period, and see how our daughter handled her dad not being there. However, his new wife has failed to answer all but one of my calls during the week, despite orders stating we are both allowed to call our daughter while she is with the other parent. Can I file a modification of parenting time to take away that time he passed to his new wife? What rights does she have as a step mother to our daughter? I was also granted First Right of Refusal, so can I just put a stop to his wife taking care of her while he is in another state immediately since I know he will not be here during his time with our daughter?

A: This requires a review of your current parenting plan to determine exactly what you can/cannot do. You can file a motion to modify the plan if the current plan is not in your child's best interests. You should get a lawyer to help you with this.
