Columbia, TN asked in Medical Malpractice for Tennessee

Q: Spouse misdiagnosed w/ pharyngitis & ear infec but has covid. Malpractice?

My spouse went to a walk-in clinic and was diagnosed by a nurse practitioner with an ear infection and pharyngitis and was written an Rx for amoxicillin. His condition got worse after taking the medication. I did research and almost none of his symptoms aligned with an ear infection and only a few did with pharyngitis. We had taken him to a testing site for COVID the day before and hadn't gotten results back yet at the time. Because his condition had gotten worse I took him to a doctor who confirmed his misdiagnosis and even said "these are the cleanest ears I have ever seen" regarding his misdiagnosed ear infection. In conclusion, knowing we are still waiting on results from the test, the doctor said he is very sure that my husband has COVID although a mild case. He said why he is doing so poorly is that the amoxicillin prescribed by the nurse practitioner weakened his immune system to the extent it couldn't fight off COVID. Do we have a malpractice case or can we be reimbursed?

A: A Tennessee attorney could advise best, but your post remains open for four weeks. This is something that would require a medical opinion. You could reach out to attorneys to discuss in greater detail. If an attorney identified a potential basis for a case, they could request the file and review it with a medical professional. Most attorneys in the med mal field offer free initial consults. Good luck
