Bristol, VA asked in Probate for Virginia

Q: My deceased fathers estate was handled by an appointed firm who also handled claim against his llc that won 43000

The appointed commissioner of revenue also had been asked prior to the appointment of an executor to represent myself and while in a consult with senior partner in firm he had me bring important paperwork in that he most surely copied because he took them out of conference room for around thirty minutes and returned without them. I then asked if I could give him a dollar at that time as a retainer fee he very confused acting asked “why would you wanna do that”I said due to the llc and stuff he asked I don’t see why I said you know maybe if there’s any lawsuits or something similar he then said well now that you mention it our firm was contacted by the Consumer to represent them in a suit against your fathers llc. I was so mad I could hardly see. The executor of the estate was assumed by a close family friend and she died about a month later. I knew the judge that the next proceedings were in front of and he denied the firm that was trying to assume executorship after Betty passed away

A: I have no idea what you are asking. First, I think you are referring to the Commissioner of Accounts for your jurisdiction, but the executor or your father's estate would have been appointed by the Register of Wills, not the Commissioner of Accounts. If you did not petition to become the Administrator, if your father was intestate, or the Administrator c.t.a. if there was a Will but someone else was named Executor, then you were not appointed, and the lawyer, whom I presume was either named Executor in the Will or was somehow retained to become Administrator or Administrator c.t.a. became the personal representative charged with administering the estate. They would not be seeking a dollar from you, because you aren't the client. I would guess that there is an LLC that was owned by your father, and the lawyer thought you wished to retain them to represent that. I'm then guessing that "Consumer" is someone who has a claim against the LLC, and they asked the same lawyer to represent Consumer against the LLC. If the lawyer took that case, there would seem to be a conflict of interests if the LLC was part of your father's estate, but I cannot interpret your post to be saying that. So, I'm left guessing as to why you were angry, but you apparently allowed some unrelated family friend to become the personal representative, and she died soon thereafter. Then, I. guessing that the law firm petitioned for someone to be substituted as Executor or Administrator c.t.a. or Administrator, and the judge didn't agree and wouldn't appoint them.

Buddy, you need a lawyer who speaks English. I have no idea what you are asking, but it sounds like there is value in the estate and there must be some reason that you aren't taking over as personal representative. Why don't you buy a consult with a lawyer to explain all of this to you?
