Q: Hello I was wondering if the judge ordered for my child father to pay child support can I tell them I dont want it

A: The answer is “it depends”. Parents have a legal dury to support their children. Funds paid for the benefit of the minor child are for the child, not the parent receiving. The Court will scrutinize any request to waive child support on the basis of (1) is the child being deprived of a standard of living that he or she might have if both parents provided support and (2) whether the custodial parent can provide for child without the other parent’s contribution. One key indicator, among many, is whether the parent waiving support is receiving any public assistance, e.g., food stamps (WIC), public healthcare for the child, or public housing assistance.
